Age assurance laws are raising concerns for open source developers as policymakers push for stricter youth safety rules across tech platforms.





Age assurance laws, aimed at protecting minors online, are sparking debate within the open source development community. With proposals advancing in the U.S., Brazil, and beyond, developers are increasingly concerned about compliance burdens and unintended consequences for decentralized ecosystems.

These laws target serious online risks such as grooming, violent content, and cyberbullying. However, their scope has expanded to include operating systems, app stores, and even developer infrastructure. For open source contributors—many of whom work voluntarily—this shift raises questions about feasibility and fairness.

Key Legislative Proposals

In the U.S., states like California, Colorado, Illinois, and New York are considering laws that require operating systems and app stores to collect and transmit users’ age data via real-time APIs. For example, California’s AB 1043 and AB 1856 would mandate age signals at account setup, while New York’s S 8102 extends obligations to device manufacturers. Brazil’s Digital Statute for Children and Adolescents (Digital ECA), enforceable as of March 2026, applies broadly to digital services but exempts collaborative and free software models—though enforcement details remain unclear.

GitHub, a key player in the open source sphere, has successfully secured exemptions for open source platforms in some proposals. For instance, France’s Social Media Minimum Age bill explicitly excludes open source collaboration sites, following advocacy efforts that highlighted these platforms’ educational and low-risk nature.

Impact on Open Source Ecosystem

Open source communities operate on principles of decentralization, collaboration, and transparency. Requirements to collect and manage user data or restrict software installations through centralized app stores could undermine these values. Moreover, many open source projects are maintained by small teams or individuals with limited resources, making compliance with sweeping regulations challenging.

Broad definitions of “application store” also pose a threat. Some proposals could classify developer tools like package managers or code repositories as app stores, despite their fundamentally different functions. Misaligned definitions risk creating legal uncertainties that discourage participation in open source projects.

Policymaker Engagement

Despite these challenges, there are positive signs. Policymakers in Colorado, for instance, recently clarified that software downloaded outside of app stores is exempt from proposed age assurance requirements. Similarly, the EU’s Cyber Resilience Act was refined through collaboration with developers to better align with the open source ecosystem’s realities.

GitHub continues to advocate for balanced approaches, emphasizing the importance of preserving open source innovation while safeguarding youth online. Developers are encouraged to engage directly with policymakers through public consultations or by joining organizations like the Open Source Initiative and the FreeBSD Foundation.

Looking Ahead

As these laws evolve, the open source community has a critical opportunity to shape outcomes. GitHub plans to host a Maintainer Month livestream on May 22, 2026, featuring panelists from key open source organizations to discuss the implications of age assurance policies. Developers and stakeholders can use forums like this to ensure laws support child safety goals without stifling collaboration or innovation.

While the push for age assurance reflects legitimate concerns, clearer distinctions and exemptions are essential to protect the unique nature of open source development. With active engagement, the community can help strike a balance that works for both young users and the broader software ecosystem.
